From 10 January 2022, the Italian Privacy Guarantor has introduced new guidelines on the use of Cookies.
These rules provide for the Cookie Banner :
accept and reject buttons (or an “x” with a reject function, a “continue without accepting” button, etc.);
consent by category;
processing purposes;
mention of the right to withdraw consent;
link to the Cookie Policy.
Furthermore, the new guidelines state that:
the cookie policy must be accessible from every page, not just from australia phone number list the banner;
legitimate interest does not constitute a valid legal basis for cookies;
consent to scroll is no longer valid;
cookie walls are not allowed (unless alternatives to enjoying the content are offered);
you can ask to give consent again if at least 6 months have passed since the last acquisition.
The Guarantor also specifies that in order to consider a user's action as valid consent to the installation of cookies, this action must correspond to an "unequivocal, documentable" and "recognizable and recordable IT event by the owner".
For this, you need a cookie preference log that includes:
who provided consent:
when and how consent was acquired;
the form presented to the user;
the preferences expressed;
a reference to any legal documents and conditions in place at the time you obtained consent.
